SAFETY STANDARDS

The safe completion of the work under this Agreement and the safety of all persons involved in the work are material to this Agreement. Supplier/Sub-Supplier (hereafter both referred to as Supplier) will fully and completely comply with all federal, state, provincial and local laws and regulations regarding, relating to and/or arising out of this Agreement, the work and the safety of the work. Supplier will also procure and maintain any and all licenses, permits, and other authorizations required by federal, state, provincial and local laws and pay all costs associated therewith. Supplier shall provide copies of all drivers’ licenses and certifications to Company.

The United States Department of Transportation, Federal Highway Administration, has published standards and guidelines for the safe operation of Pilot Car Escorts. These standards and guidelines may be found in electronic format on the Department's website: https://ops.fhwa.dot.gov.

Among those published standards and guidelines for the safe operation of Pilot Car Escorts are the following:

Pilot/Escort Vehicle Operators Best Practices Guidelines, FHWA-HOP-16-051; and

Pilot/Escort Vehicle Operators Training Manual, FHWA-HOP-16-050,

which incorporate by reference the most current version of the Manual on Uniform Traffic Control Devices for Streets and Highways (MUTCD).

There are also various state standards, certifications and permits that must be followed and obtained. In conjunction with any applicable state standards, certifications and permits, these federal published standards and guidelines shall be followed by all Suppliers.

This Agreement contains certain specific safety requirements, as may be set forth below. However, to the extent that there is any discrepancy between the specific safety requirements in this Agreement and the requirements of any applicable state standards, certifications and permits and the federal published standards and guidelines, the state and federal requirements shall control.

Requirements for Pilot/Escort Vehicle

Lights

An escort vehicle must have two flashing amber lights or one rotating amber beacon of not less than eight inches in diameter fixed to the roof of the escort vehicle. The light must be visible from all sides of the escort vehicle.

Signs

An escort vehicle must display a sign on either the roof of the vehicle or the front and/or rear of the vehicle with the words "OVERSIZE" or "WIDE LOAD." The sign must be:

Size – 5 to 7 feet in length, 12 to 18 inches in height

Color - yellow background with black lettering

Size of lettering – 8 to 10 inches high with a brush stroke at least 1.4-inches wide

Visibility - visible from the front and rear of the vehicle while escorting the permitted load

The sign must not be used at any other time.

Flags

Warning flags must be made of red or orange, fluorescent material and at least 12-inches square. Flags should be securely mounted on a staff or securely fastened to at least one corner to the widest extremities of the over width vehicle and placed at the rear of an overlength vehicle or vehicle with a rear overhang in excess of four feet.

Radio

An escort vehicle must maintain two-way communications with the permitted vehicle and other escort vehicles involved with the movement of the permitted vehicle. When the Pole Car is proceeding under the structure, the microphone must be engaged and the button held down to ensure continuous communication.

Height Pole

Any permitted vehicle that exceeds 14-feet in height must have a front escort vehicle equipped with a height pole made of nonconductive metal to accurately measure overhead obstructions. Before the permitted vehicle may proceed under a structure the front escort must validate the structure can be safely cleared from all lanes. If the Pole Car hits the overhead structure:

· DO NOT PROCEED

· PULL OVER AND ASSESS THE SITUATION

· IMMEDIATELY CALL DISPATCH

Requirements of Pilot/Escort Vehicle Operator

· Must have successfully completed all required coursework and obtained all necessary certifications;

· Must have a valid state driver’s license and successfully completed the NSC 8-hour Defensive Driving course;

· Must be at least 21 years of age and must have at least three years of experience;

· The escort vehicle operator must warn the traveling public when any of the following conditions exists:

· A load vehicle must travel over the center line of a narrow bridge or roadway;

· A load vehicle makes any turning movement that will require the permitted vehicle to travel in the opposing traffic lanes;

· A load reduces speed to cross under a low overhead obstruction or over a bridge; and

· A load vehicle creates an abnormal and unusual traffic flow pattern.

· In addition, if the height pole on escort vehicle hits or detects an overhead object during travel, the operator shall immediately, 1) turn on emergency flashers, 2) stop the escort vehicle and safely pull over, 3) advise the load vehicle via two-way communication, 5) hand signal the load vehicle to safely stop, 6) safely flag and mark the stopped load vehicle; make any necessary calls to law enforcement to redirect traffic and assist in redirecting load vehicle.
